Terms & Conditions

THE FINE PRINT The Space To Move TERMS + CONDITIONS. PLEASE READ CAREFULLY BEFORE BOOKING ANY CLASSES, APPOINTMENTS, COURSES, WORKSHOPS OR EVENTS WITH US Please read our Terms and Conditions before signing up for membership on a “Monthly Unlimited Membership” or “Founding Membership” basis, or where you wish to purchase classes, private sessions, courses, events and workshops (“Sessions”) with a “Drop In”, “Class Pass” or “Appointment Pass” credit. Sessions can be held in-person at The Space To Move Studio or online as a Livestream hosted by The Space To Move. Please note that different terms and conditions apply depending on if you sign up for membership on a “monthly” or “annual” basis (Section A below) or if you elect to purchase Sessions by Drop in, Class Pass or Appointment Pass (Section B below). Please also refer to the General Section (Section C below) which applies to everyone who attends any “Session” at The Space to Move in-studio or livestream. In these Terms “we”, ”us”, ”our” means The Space to Move Studio’s Limited and “you”, “your”, “yours” means you, the client. “The Space To Move” is a trading name of The Space to Move Studio’s Ltd. IMPORTANT INFORMATION ABOUT DATA PROTECTION: The nature of our business and the provision by us of Sessions to you means that we will collect and process certain of your personal data from time to time. We will only do so in accordance with our Privacy Notice. TERMS AND CONDITIONS – FOR CUSTOMERS WITH, OR WISHING TO, PURCHASE A “MONTHLY UNLIMITED MEMBERSHIP” or “FOUNDING MEMBERSHIP” Please read these Terms carefully before signing up for a “monthly unlimited membership” and a “founding membership”. Please also refer back to these Terms from time to time, as they will continue to apply to your “membership” . By signing up for a “monthly unlimited membership” or “founding membership” you are confirming that you have read the Terms and agree to be bound by them. Section A of these Terms constitutes a “monthly unlimited membership” contract between you and us. A. 1. INTRODUCTION All “Sessions” provided at our premises or by us under the The Space To Move brand are supplied by The Space to Move Studio’s Ltd, trading as The Space To Move, (Registered Office: 6 Providence Terrace, Providence Terrace, Chippenham, England, SN15 1HD. Company Number: 16056922 , subject in each case to the following express Terms. 2. MONTHLY UNLIMITED MEMBERSHIP CONTRACT PERIOD Starting July 2025, all Monthly Unlimited Memberships will have an initial fixed term of 12 months, excluding any time the membership is frozen. You will make 12 monthly payments of £199, each automatically debited from your designated card linked to your Momence account. Payments will be taken on the same calendar day each month as your sign-up date (or the closest equivalent day in shorter months). During this initial 12-month period, you cannot cancel or end your membership early. After the initial 12-month term, your membership will automatically continue on a rolling monthly basis at the prevailing monthly rate, unless you choose to cancel by giving 31 days’ notice (see Section 8). After completing 6 months of active membership, you may freeze your membership once for up to one calendar month. The freeze period pauses your membership, and the contract will be extended by the freeze duration (i.e., the freeze time does not count towards the 12 months). The membership will automatically restart after the freeze period ends, continuing for the remaining contract duration. No refunds or partial refunds will be given under any circumstances. 3. WHAT’S INCLUDED IN THE MONTHLY UNLIMITED MEMBERSHIP Unlimited access to all group Pilates classes on Reformer, Mat and Tower equipment. You may book and attend as many classes as you like within any day, week, or month. 4. WHAT’S EXCLUDED FROM THE MONTHLY UNLIMITED MEMBERSHIP Use of community spaces. Private 1:1 or 2:1 sessions. Courses, workshops and special events. These must be booked and paid for separately. 5. PAYMENT OF MEMBERSHIP FEES You must create a membership profile on Momence to manage payments and bookings. Your first membership payment will be charged on the date you sign up. Subsequent payments will be automatically debited monthly on the same day (or nearest equivalent) as your initial sign-up date. You must keep your chosen payment card details updated in your Momence account. Payments are processed via Stripe, our secure payment partner. 6. NON-PAYMENT OF MEMBERSHIP FEES If a payment fails or is overdue, access to sessions and events may be suspended until full payment is made. Future bookings will be automatically cancelled if fees remain unpaid. After two unsuccessful payment attempts, your membership will be downgraded to a “Drop-in” customer until payment is cleared. We reserve the right to notify credit reference agencies of unpaid debts. 7. MEMBERSHIP FEE CHANGES We may review and change membership fees periodically. After your initial 12-month contract, if you continue your membership on a rolling basis, your fee will stay the same unless we notify you otherwise. We will give you at least 31 days’ notice before any fee changes. You may cancel your membership within the 31-day notice period if you do not agree with the new fee. 8. CANCELLATION OF MEMBERSHIP You may only cancel your membership at the end of your initial 12-month contract, excluding any frozen time. To cancel, you must provide at least 31 days’ written notice via email to hello@thespacetomove.com Notice to cancel at the end of the fixed term must be given at least 31 days before your contract expires to avoid further charges. After the initial term, if you continue on a rolling basis, you must still give 31 days’ notice to cancel. If a payment is due during your notice period, that payment will be taken and your membership will continue until the day before your next payment date. 9. FREEZING YOUR MEMBERSHIP You cannot freeze your membership during the first 6 months. After 6 months, you may freeze your membership once for up to one calendar month. To freeze your membership, you must notify us in writing at least 31 days before your next payment date via email to hello@thespacetomove.com. Your membership freeze will begin after your payment date and automatically restart one calendar month later. Only one freeze of up to one month is allowed every 12 months, excluding frozen time. Freezing for longer than one month will result in forfeiting your membership and rejoining will require signing up at the current monthly rate. 10. BOOKING SESSIONS Sessions are listed clearly on the online timetable. You may book any number of included sessions up to 14 days in advance using Momence. You are responsible for ensuring your bookings are confirmed. Membership does not guarantee session availability; book early to secure your spot. 11. CHANGING OR CANCELLING BOOKINGS & NO-SHOWS You may cancel or change bookings without charge up to 24 hours before the session. Bookings made within 24 hours of a session start cannot be changed or cancelled. Late cancellations or no-shows will incur a charge of £25 per session. Charges will be added to your account and collected automatically. Non-payment of late cancellation fees may result in suspension of your membership account. 12. IF WE CANCEL YOUR BOOKING If we cancel a session, we will make reasonable efforts to notify you by email or app notification. 13. SESSION BOOKING CONFIRMATION Your booking is only confirmed when you receive confirmation from us and the session appears in your Momence account. Please check your bookings before attending. If you do not receive confirmation, contact us at hello@thespacetomove.com. Sessions are subject to availability and not guaranteed. Section B of these Terms constitutes a “Founding Membership” contract between you and us. All “Sessions” provided at our premises or by us under the The Space To Move brand are supplied by The Space to Move Studio’s Ltd, trading as The Space To Move, (Registered Office: 6 Providence Terrace, Providence Terrace, Chippenham, England, SN15 1HD. Company Number: 16056922 , subject in each case to the following express Terms. B.1. MEMBERSHIP OVERVIEW 1.1. Founding Membership is a one-time, upfront payment that grants access to 200 studio classes per year over a 12-month period, starting from the date of activation.
1.2. This membership is designed for early supporters of The Space to Move Studios and is offered at a special rate which may not be available again. 2. PAYMENT 2.1. Membership fees must be paid in full upfront at the time of registration. The fee is non-refundable, except as outlined in Section 6.
2.2. All prices are inclusive of applicable taxes, unless otherwise stated. 3. CLASS ACCESS 3.1. Founding Members are entitled to attend up to 200 studio classes within the 12-month membership period.
3.2. Class access is subject to availability and must be booked in advance via our online booking system or mobile app.
3.3. Unused classes do not roll over beyond the 12-month period and cannot be transferred or credited. 4. MEMBERSHIP DURATION & EXPIRY 4.1. The membership is valid for 12 consecutive months from the date of activation.
4.2. It will automatically renew after 12 months or upon attendance of 200 classes, whichever comes first.
4.3. If you do not wish to renew, then please state in writing no less than 31 days prior to the end date by emailing hello@thespacetomove.com 5. CANCELLATIONS AND CLASS NO-SHOWS 5.1. You must cancel any booked class at least 24 hours in advance. Late cancellations or no-shows may result in the class being deducted from your remaining allowance.
5.2. Repeated no-shows or misuse of the booking system may result in suspension of booking privileges. 6. REFUND POLICY 6.1. Founding Memberships are non-refundable once activated.
6.2. In exceptional circumstances (e.g., serious illness or relocation), refund requests may be considered on a case-by-case basis, at the sole discretion of The Space to Move Studios.
6.3. If we are required to close the studio for more than 30 consecutive days due to events outside our control (e.g., force majeure), we may offer extensions, class credits or other compensation at our discretion. 7. MEMBERSHIP FEE CHANGES 7.1. We reserve the right to review and change membership fees and session fees periodically.
7.2. As a Founding Member, your initial 12-month membership is paid upfront and will not be affected by any fee changes during that period.
7.3. If you are offered the option to continue your membership after the initial term (e.g., on a rolling monthly basis), the membership fee will remain at the same rate unless otherwise advised.
7.4. We will give all members at least 31 days’ notice of any changes to fees.
7.5. If you choose not to continue with your membership following notification of a fee change, you may cancel your membership by providing 31 days’ written notice, and no further payments will be taken beyond that period. 8. NON-TRANSFERBILITY 8.1. Founding Memberships are non-transferable and may only be used by the individual who purchased or was gifted the membership. 9. CONDUCT & STUDIO RULES 9.1. Members are expected to follow all studio policies, including health and safety protocols, dress code and conduct guidelines.
9.2. We reserve the right to suspend or terminate membership without refund if a member behaves in a manner deemed inappropriate or harmful to staff, other members or studio property. 10. CHANGES TO TERMS 10.1. We reserve the right to amend these Terms at any time. Members will be notified of significant changes in writing or via email.

SESSION BOOKING CONFIRMATION Your booking of a Session is not complete until you have received a booking confirmation from us & the booking shows in your The Space To Move Momence member account. Please make sure your booking is confirmed before you attend the Session to avoid disappointment. If you do not receive confirmation, please contact us by e-mail (hello@thespacetomove.com), please note that we may not be able to respond immediately (see Section D, clause 6.c for details on response time). All Sessions are offered by us subject to availability. We do not guarantee availability of a Session at any time. C. TERMS AND CONDITIONS – FOR CUSTOMERS WISHING TO BECOME A MEMBER VIA “DROP IN”, “CLASS PACK” OR “APPOINTMENT PASS” Please read these Terms carefully before proceeding. By making a payment of a “DROP IN”, "CLASS PACK” OR “APPOINTMENT PASS” you are confirming you have read the Terms and agree to be bound by them. 1. INTRODUCTION All Sessions provided at our premises or by us under the The Space To Move brand are supplied by Tendu Training Limited, trading as The Space To Move, (Registered Office: Studio 512/513 The Green House, The Custard Factory, Birmingham, B9 4DP. Company number: 10360954), subject in each case to the following express Terms. 2. “DROP IN”, "CLASS PACK” OR “APPOINTMENT PASS” You are bound by Section C of these Terms from the date on which you make a payment to attend a Session until such time as you cease your attendance or your passes expire. “DROP IN” : this is a full priced credit for any Session. "CLASS PACK 5/10” : this is a bulk purchase of class credits which contain a discount. “APPOINTMENT PASS” : this is a purchase for (a) credit(s) to a private session. 3. “DROP IN”, "CLASS PACK BUNDLE” OR “APPOINTMENT PASS” EXPIRY DATES All “Drop In”, "Class Pack Bundle” Or “Appointment Pass” credits have an expiry date. These can be extended at an additional price of £10 per week from the date of expiry. There are no exceptions to this rule. 4. BOOKING SESSIONS Each Session will be shown clearly on the online timetable. You will need to create a The Space To Move membership profile on Momence to book any Session. Bookings for Sessions can be made up to 14 days in advance or 21 days for members with memberships. Bookings can be made only via our software provider Momence. It is your responsibility to ensure that you have made your booking and (where relevant) submitted payment correctly. Booking Appointments will be completed on request via hello@thespacetomove.com. 5. PAYMENT for “DROP IN”, "CLASS PACK” OR “APPOINTMENT PASS” You can pay for Sessions via the “DROP IN”, "CLASS PACK” OR “APPOINTMENT PASS” options shown in your The Space To Move Momence account. Payment for your Sessions may be made by credit card or debit card. Payments can be made online via your The Space To Move Momence account only. In exceptional circumstances, we can take card payments on The Space To Move premises. 6. SESSION FEE CHANGES We reserve the right to review and change Session fees periodically. The prices will be reflected on purchase of a new “drop in”, "class pack” or “appointment pass”. All existing “drop in”, "class pass” or “appointment pass” credits are valid until expiry. 7. SESSION BOOKING CONFIRMATION Your booking of a Session is not complete until you have received a booking confirmation from us & the booking shows in your The Space To Move Momence member account. Please make sure your booking is confirmed before you attend the Session to avoid disappointment. Your session will show on your group or appointment bookings section on your The Space To Move Momence account. If you do not receive confirmation, you can contact us by e-mail (hello@thespacetomove.com), however, please note that we may not be able to respond immediately (see Section C, clause 6.c for details on email response time). All Sessions are offered by us subject to availability. We do not guarantee availability for a Session at any time. 8. IF WE CANCEL YOUR BOOKING In the event that we cancel a Session that you have booked, we will make reasonable efforts to contact you by email or in-app notification to let you know. 9. PRE-PAID “CLASS PACKS” AND PROMOTIONAL PURCHASES “Class Pack” Bundles are pre-paid bundles of Session types that give the customer a bulk discount at the point of purchase. Pre-paid “Class Pack” Bundles and promotional purchases are only applicable against the applicable Session type and the applicable Session genres at the point of purchase and cannot be swapped or exchanged at any time. “Class Pack” Bundles and promotional purchases cannot be exchanged for any other service or product that we offer. “Class Pack” Bundles and promotional purchases are non-refundable. “Class Pack” Bundles and promotional purchases have an expiry date, these may be extended at an additional price of £10 per week from the date of expiry. There are no exceptions to this rule. 10. “INTRO” OFFER OR “PRIVATE INTRO SESSION” The “Intro”, and “Private Intro session” offers are limited to one purchase per customer and may only be purchased once. We reserve the right to not fulfil any future bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Promotion. The rules for “Late Cancellation” and “No-Show” apply. (Section D, clause 1). The expiry date for the “Intro” and “Private Intro session” offers can not be extended. There are no exceptions to this rule. WHAT’S INCLUDED IN AN “INTRO OFFER”: All Reformer/ Tower and Mat Pilates Sessions are included. WHAT’S EXCLUDED IN AN “INTRO” OFFER: Community spaces, private Sessions, Pre-natal Sessions, Post-Natal Sessions, Courses, Workshops and Events are excluded. SECTION D : GENERAL TERMS AND CONDITIONS. These are applicable to all customers of The Space To Move, who hold a “FOUNDING MEMBERSHIP”, “MONTHLY PAYG MEMBERSHIP” or who are a member via “DROP IN”, “INTRO OFFER”, “CLASS PACK BUNDLE” or “APPOINTMENT PASS”, or who attend a workshop, course or event, in-studio or Livestream. 1. CHANGING OR CANCELLING YOUR BOOKING, AND NO SHOWS. You may change or cancel your booking for a Session, without charge, up to 24 hours before the start of the Session that you have booked. You can cancel your Session via your account on Momence or through The Space To Move Momence App. Your online account will be automatically credited with the cancelled Session credit and you can book any such Session re-credited to your account in accordance with the provisions of these Terms. If you book onto a Session within 24 hours of its scheduled start time, there is no entitlement to change or cancel. Late Cancellation or No Shows - a Late Cancellation is a cancellation of a session within 24 hours of your Session start time. A No-Show is not attending your Session without cancellation. Late Cancellation or No Shows (“Drop-In”, “Class Pack” or Appointment Pass” members): One Session credit will be deducted for Late Cancellations or No-Shows for any Sessions paid for by “Drop-In”, “Class Pack” or “Appointment Pass” members. Late Cancellation or No Shows (“Founding Membership”, “Monthly Unlimited Membership”): Any Late Cancellations or No-Shows will be charged at the rate of a “Drop-In” or £25 per session, for “Founding Membership” and “Monthly Unlimited Membership” offer customers. These resulting additional penalty charges will be made at any point before the end of the following month and processed via your original payment method. Non-Payment of Penalty Fees : “Founding Membership”, “Monthly Unlimited Membership”, members, your pass will be immediately withdrawn if penalty fees cannot be taken automatically from the account due to an incorrect card or no card details.The member will be refused access to any Sessions. Members will have to purchase a “Drop-In” or “Class Pack” Bundle to book any further sessions until payment is made. 2. LATENESS POLICY Group Sessions: We operate a strict Lateness Policy which prevents you taking part in a Session if you arrive once the class has started. If you arrive more than 5 minutes late for the relevant Session, in such situations you will be deemed to be “Late”. This policy is in place to prevent injury and to be mindful of the teacher and other participants in the Session. If you are deemed “Late” then you will be charged a credit as if you attended the session or be administered with a “No-Show” penalty if you hold a “Founding Membership” or “Monthly Unlimited Membership”. Private Sessions: if you are more than 30 minutes late, without acknowledged written notice to the instructor, the same rule applies. In line with our cancellation policy, you will not be refunded for Sessions you are unable to attend because you are Late. 3. PRE-NATAL POLICY As soon as a member knows she is pregnant, they must inform us immediately by email to hello@thespacetomove.com and pause any classes until 12 weeks or until their Doctor or midwife sign them off to do so. After 12 weeks; Regular The Space To Move clients can attend classes as advised by the Management team at The Space To Move. For New Clients, please email us before you make your first booking at hello@thespacetomove.com with any enquiries so we can guide you to the correct class. 4. POST-NATAL POLICY New or Returning clients, must advise us if they have recently had a baby, we require our clients to attend post-natal classes from 8 weeks post partum, or 11 weeks C-Section. All clients must have been signed off to exercise by their Doctor or Midwife. Please email us at hello@thespacetomove.com with any pre/post-natal enquiries so we can guide you to the correct class. 5. FILMING POLICY: At The Space To Move we have a ‘No Filming During Class' policy. With the teachers agreement, you can take pictures of the studio before or after class (excluding any other clients, unless you have their individual permission). During class, we ask you to refrain from doing any filming during class, not only is this distracting for the teachers, unfair on other clients and an infringement on their personal privacy, it can pose a health and safety risk for you too. Anyone who is filming will be asked to stop, immediately. If you wish to film yourself doing pilates for social media or any other purposes, please get in touch with us and you can book in a private session with one of our teachers and film what you would like to film during that session. 6. PROMOTIONAL OFFERS From time to time we may run various promotions, prize draws and other offers (“Promotions”). We may implement separate terms and conditions in respect of any such Promotion, and will advise you accordingly where this is the case. However, notwithstanding this: We reserve the right to end any promotion without warning at any time. We also reserve the right to withdraw your right to any Promotion if we consider, in our absolute discretion, that you have abused, misused or gained an unfair advantage in respect of the Promotion. Misuse includes, but is not limited to, the creation of multiple customer accounts and self-referral. Additionally, we reserve the right to not fulfil any future bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Promotion. Any prizes offered by us in connection with a Promotion must be claimed within 21 days of announcement of the winners. We have 45 days to issue any such prize. We reserve the right to substitute any prize or promotion for the equivalent value in Sessions. 7. HOW WE CAN CONTACT EACH OTHER By you: Any written notice or enquiry / feedback should be e-mailed to hello@thespacetomove.com. You may change or cancel a Session online only through your online Momence account or The Space To Move Momence app. By us: We may contact you using any of the contact details you provide to us when you sign up for membership, which may include via telephone or text message. Our Privacy Notice sets out how we may process your personal data, which includes the contact details you provide to us. Time elapse of communication between Us and You. We have a micro administration team and therefore any email will be responded to within 48 hrs of receipt. You can take all immediate and urgent actions required for Sessions through your The Space To Move Momence members account. With anything else, we will be in touch and endeavour to support you in the best way possible within the 48hr window, or before. 8. LIABILITY We not are responsible for any loss or damage that you suffer at or around the studio.,We are not responsible for any loss or damage caused by us or any of our freelance staff or those hiring our premises, or for loss or damage which is your own fault or which is attributed to a third party unconnected with the provision of our services. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we accepted your order. We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or for any breach of any terms implied by law. 9. FORCE MAJEURE We shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms if the delay was due to any cause beyond our reasonable control, including, but not limited to, acts of god, terrorism, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T. system failures, viruses, difficulties in obtaining raw materials, labour , fuel, parts or machinery, power failure or breakdown in machinery. 10. WAIVER No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver, to be effective, must be in writing. 11. SEVERABILITY If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law. 12. ENTIRE AGREEMENT These Terms together with our disclaimer and any policies we have in force from time to time constitute the entire agreement between us and you and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between us and you. 13. THIRD PARTY RIGHTS These Terms constitute a contract between you and us. No other person shall have the right to enforce any of these Terms. 14. GOVERNING LAW AND JURISDICTION These Terms shall be governed by and construed in accordance with English law and the parties hereby agree to submit the exclusive jurisdiction of the English courts.
