The Space To Move reserves the right to refuse any membership application at its absolute discretion. 4. MEMBERSHIP CONTRACT All Essential, Signature and Ultimate Memberships are subject to a minimum commitment of 12 consecutive months. Membership payments are collected monthly via your nominated payment method through Momence. Following the initial 12-month commitment, memberships will automatically continue on a rolling monthly basis until cancelled in accordance with these Terms. Memberships may not be cancelled during the initial commitment period except where required by law or at the sole discretion of The Space To Move. By purchasing a membership, you confirm that you are at least 18 years of age or have the consent of a parent or legal guardian. SECTION 2 – MEMBERSHIP MANAGEMENT & BOOKINGS 5. MEMBERSHIP PAYMENTS 5.1 Payment Method All membership payments are collected automatically via your nominated debit or credit card through our booking platform, Momence. By purchasing a membership, you authorise The Space To Move to collect recurring monthly payments until your membership is cancelled in accordance with these Terms & Conditions. It is your responsibility to ensure your payment details remain valid and up to date. Failure to maintain an active payment method may result in your membership being suspended. 5.2 First Payment Your first payment will be taken immediately upon joining unless otherwise agreed as part of a promotional offer. Future payments will be collected on the same calendar date each month, or the nearest equivalent date where applicable. 5.3 Failed Payments If a scheduled payment cannot be collected: • Your membership may be suspended immediately. • Future bookings may be cancelled. • Access to classes may be restricted until payment has been successfully processed. The Space To Move reserves the right to retry failed payments and contact you regarding any outstanding balance. Repeated failed payments may result in termination of your membership. 5.4 Membership Fee Reviews Membership fees may be reviewed from time to time. Should membership prices increase, we will provide a minimum of 31 days' written notice before any changes take effect. Price changes will not affect your minimum contract period. 6. BOOKING CLASSES All classes must be booked in advance through your Momence account. Bookings are accepted on a first come, first served basis and are always subject to availability. Holding an active membership does not guarantee a place in any particular class. We recommend booking classes in advance to avoid disappointment. 6.1 Booking Windows The current booking windows are: Essential Membership Book up to 21 days in advance. Signature Membership Book up to 28 days in advance. Ultimate Membership Book up to 28 days in advance. Founding Membership Book up to 28 days in advance. Class Packs & Pay As You Go Book up to 21 days in advance. Booking windows may change from time to time. Any amendments will be communicated to members in advance. 6.2 Booking Confirmation A booking is only confirmed once it appears within your Momence account and you have received confirmation via email or app notification. If you have not received confirmation, it is your responsibility to check your account or contact us before attending. 6.3 Class Availability Whilst we make every effort to accommodate all members, class sizes are limited. The Space To Move cannot guarantee availability on any class, instructor or timetable. 7. WAITLISTS Where a class is fully booked, members may join the automated waitlist through Momence. Spaces are allocated automatically in chronological order as cancellations occur. If a place becomes available, you will automatically be added to the class and notified by Momence. It is your responsibility to monitor your bookings and remove yourself from the waitlist if you no longer wish to attend. Members may be automatically added to a class up to one hour before the scheduled class start time. Once you have been added from the waitlist, the standard cancellation policy immediately applies. 8. MEMBERSHIP FREEZES We understand that circumstances occasionally arise where you may need to temporarily pause your membership. Essential, Signature and Ultimate Memberships may be frozen subject to the following conditions: • Memberships become eligible for freezing after six consecutive months of active membership. • One freeze is permitted during each 12-month membership period. • The maximum freeze duration is one calendar month. • Freeze requests must be submitted in writing at least 31 days before your next payment date. • Memberships will automatically restart at the end of the agreed freeze period. The duration of any approved freeze does not count towards your initial 12-month commitment and your contract will automatically be extended by the length of the freeze. Freeze requests cannot be backdated. Any exceptions remain entirely at the discretion of The Space To Move. 9. UPGRADING OR DOWNGRADING YOUR MEMBERSHIP Members may upgrade their membership at any time, subject to availability. Additional charges will be calculated from the date the upgrade takes effect. Downgrades may only take effect after completion of the initial 12-month commitment unless otherwise agreed by management. Membership places are limited and The Space To Move cannot guarantee availability within any membership tier. 10. LATE CANCELLATIONS & NO-SHOWS All bookings at The Space To Move are subject to a strict 24-hour cancellation policy. If you cancel a booked class less than 24 hours before the scheduled start time, or fail to attend without cancelling, the following will apply: Essential, Signature, Ultimate & Founding Memberships One class credit will be deducted from your available monthly or annual class allowance. Class Packs & Pay As You Go (Drop In) One class credit or booking will be forfeited. Class credits deducted as a result of a late cancellation or no-show are non-refundable, non-transferable and cannot be reinstated. We understand that genuine emergencies can occur. In exceptional circumstances, The Space To Move may choose to reinstate a class credit at its sole discretion; however, we are under no obligation to do so. Repeated late cancellations, no-shows or misuse of the booking system may result in a temporary suspension of booking privileges or, where appropriate, termination of membership. 10.1 If We Cancel a Class Occasionally, it may be necessary for The Space To Move to cancel or reschedule a class due to instructor illness, unforeseen circumstances or operational requirements. Where possible, members will be notified as soon as reasonably practicable. If we cancel a class, any class credit used for that booking will automatically be returned to your account. The Space To Move is not liable for any travel expenses, childcare costs, loss of earnings or any other indirect costs incurred as a result of a cancelled or rescheduled class. 10.2 Instructor Changes From time to time, instructors may change without prior notice due to illness, holidays or operational requirements.
